Do You Need a Mobile Notary?

Scenario #1: Your company is in the midst of a lawsuit and you are one of its top executives. You have consulted your lawyer, who has prepared an urgent affidavit for you to sign, but you have to leave for the airport to attend a business meeting and you don’t have time to visit the office of a commissioner of oaths. What do you do?

Scenario #2: One of your loved ones is aged, elderly, sick or otherwise immobile. He or she has sold a piece of property outside of the city where he or she lives and urgently requires the sale documents to be signed, notarized and delivered in time for the closing. What can you do?

Scenario #3: Your grandmother is terminally ill and confined to a hospital. She must sign an important document, such as a Power of Attorney or Last Will and Testament in the presence of a notary, but cannot travel. How do you resolve this dilemma? What service do you need?

How to Prepare for a Mobile Notary Visit

1. Before you contact Red Seal Notary to request mobile service, be sure that the person requiring the service is capable of reading, understanding, and physically signing the document. This is extremely important, as an individual suffering from Alzheimer’s or Dementia, for example, is unable to make an informed decision, and because of this, his or her document cannot be properly executed. This is why individuals should ensure that their Power of Attorney, Last Will and Testament, Living Will, etc. are prepared while they are still competent and able to make important decisions.
2. The person signing the document(s) must also present valid, non-expired, government-issued photo identification, such as a driver’s license, passport, or certificate of Canadian citizenship. If proper identification is not available, it will be extremely difficult, if not impossible, for the notary to confirm the person’s identity. It may seem obvious from the surroundings who the person is, but one of the things a notary has been entrusted to do by the government is to satisfy him- or herself as to the identity of the person who is executing the document.
3. If witnesses are required, they must be present when the notary arrives, and they must also show the notary government-issued photo ID. Not all documents require more than one witness, and sometimes the only witness needed is the notary. However, some documents, such as Powers of Attorney and wills usually require at least two witnesses in addition to the notary.
4. It is important to note that notaries cannot provide legal advice. Therefore, the individual requiring the notarizations should, ideally, seek the services of a lawyer to assist with the preparation of wills and Powers of Attorney, prior to contacting a notary. Additionally, it is up to the individual to ascertain how many witnesses are required for the documents being executed. Notaries can, however, prepare basic affidavits and statutory declarations.
