Who is a commissioner of oaths?
Commissioners of oaths are persons empowered to:
- administer the swearing of oaths and affirmations
- administer the oath/affirmation for the taking of oral testimony
- administer any statutory declaration
A commissioner of oaths only certifies that the required oath or affirmation or declaration has been properly administered, they do not certify the truth of the statements contained in a document.
In most Provinces and Territories, the deponent or declarant signing the document must appear in person or through video conferencing before the commissioner of oaths, who must be satisfied about the authenticity of their identity and signature.
The deponent’s or declarant’s signature can usually be confirmed through comparing the signature on a piece of identification such as a driver’s license or passport.
Types of Oaths
Swear of an oath – the deponent is required to swear that the contents of the affidavit as subscribed are true or solemnly affirm and declare that the contents of the affidavit as subscribed are true.
Solemn declaration – the deponent must declare and make the solemn declaration conscientiously believing it to be true and knowing that it is of the same force and effect as if made under oath.
