What is an affidavit?

An affidavit is
- A legal document containing statements sworn to be true
- Often used as part of legal proceedings
- Sworn to be true, signed by the deponent
- Witnessed by a Commissioner of Oaths or a Notary Public
In an affidavit:
- Make statements of fact, not theories or opinions
- You can make statements about what you reasonably believe to be true, but if so, you have to be clear that you are expressing a belief and not a fact
- You may include “exhibits”.

How to swear and sign
- Prepare the affidavit, but do not sign in advance. The affidavit has to be signed in front of the Commissioner of Oaths or a Notary Public
- You need a valid government-issued photo ID
- You can appear in person or some cases and jurisdictions, virtually to swear and sign
